Terms of Service

These Terms of Service govern all use of superbiamachining.africa and all enquiries, quotations and orders placed with Superbia Machining and Trading (Pty) Ltd, whether made via this website, WhatsApp, telephone, email or in person.

1 Parties

"The Company", "we" or "us" refers to Superbia Machining and Trading (Pty) Ltd, Registration No. 2016/249965/07, trading from 15th Ave & Charl Cilliers St, Anderbolt, Boksburg, 1459, Gauteng.

"Customer" or "you" means any person, company or entity submitting an enquiry, inspection request or order with the Company.

2 Website use

This website is provided to present our machining, fabrication, pipe fitting, profiling & bending and surface treatment services, and to submit enquiries and quote requests.

  • You may not use this website for any unlawful purpose or to transmit harmful code.
  • All content, photography, logos and branding on this website are the intellectual property of the Company or used under licence and may not be reproduced without prior written consent.

3 WhatsApp & other communications

We communicate with customers via our official WhatsApp Business number, telephone and email regarding enquiries, quotations and order status.

  • By messaging our WhatsApp Business number or submitting a form on this website, you consent to us contacting you back through the same or another channel you have provided.
  • WhatsApp messaging is subject to WhatsApp's own terms of service, which are outside our control.
  • You may opt out of further WhatsApp or marketing communications at any time by replying "STOP" or emailing info@superbiamachining.africa.
  • See our Privacy Policy for how we handle personal information, including how to request deletion of your data.

4 Quotations

  • All quotations are valid for 14 (fourteen) calendar days from the date of issue unless stated otherwise.
  • Prices quoted are exclusive of VAT (15%) unless explicitly stated as VAT-inclusive.
  • Quoted prices and lead times are estimates and are not binding until a written order/job confirmation has been issued.
  • The Company reserves the right to withdraw or amend a quotation before a written order confirmation is issued, including where a site inspection reveals conditions differing from the original enquiry.

5 Orders, job acceptance & site inspections

  • An order or job is binding only when confirmed in writing by an authorised representative of the Company.
  • Verbal orders and instructions are not binding.
  • The Customer is responsible for providing safe and reasonable site access for on-site inspections.
  • Custom or special-order work may be subject to longer lead times and non-cancellation conditions once work has commenced.

6 Pricing & payment

  • Cash/COD jobs: full payment is required before dispatch or handover of completed work, unless otherwise agreed in writing.
  • Credit account customers: payment is due within 30 (thirty) days of invoice, unless alternative terms are agreed in writing.
  • Late payments attract interest at the prime overdraft lending rate plus 2% per annum, calculated daily and compounded monthly.
  • All prices are in South African Rand (ZAR).

7 Delivery, collection & risk

  • Delivery and completion lead times are estimates only and are not guaranteed.
  • Risk in goods or completed work passes to the Customer upon dispatch or handover from our premises.
  • Collection from our Boksburg workshop is available Monday–Friday, 08:00–17:00.

8 Claims, warranties & workmanship

  • Claims relating to defective workmanship or materials must be made in writing within 7 (seven) calendar days of delivery or handover.
  • The Company warrants that work will be carried out to the specification agreed in writing and to a reasonable standard of workmanship.
  • No claims are accepted for work modified, further processed, installed or used after handover.

9 Limitation of liability

  • The Company's total liability shall not exceed the invoice value of the goods or work giving rise to the claim.
  • The Company shall not be liable for indirect, consequential or economic loss arising from goods or work supplied.
  • Nothing in these terms limits liability for gross negligence or wilful misconduct under South African law.

10 Force majeure

The Company shall not be liable for any failure or delay in performance arising from events beyond its reasonable control, including natural disasters, labour disputes, supply chain disruptions, load shedding/power outages, regulatory changes, or civil unrest.

11 Consumer Protection Act (CPA)

To the extent these terms apply to natural persons acting as consumers under the Consumer Protection Act 68 of 2008, nothing in these terms limits or overrides rights granted under the CPA. In the event of conflict, the CPA prevails.

12 Governing law & dispute resolution

These terms are governed by the laws of the Republic of South Africa. Disputes shall be referred to the courts of the Gauteng Division of the High Court, or the Magistrate's Court having jurisdiction, at the Company's election.

13 Amendments

The Company may update these Terms of Service at any time. The current version is published at superbiamachining.africa/terms.php. Continued use of the website, WhatsApp communication with us, or submission of an enquiry after publication of updated terms constitutes acceptance.
